USER AGREEMENT:  Terms and Conditions

These terms of sale cover your purchase of any and all products offered on www.tqleds.com.  All users of this site agree that access to and use of this site is subjected to the following terms and conditions and other applicable law. If you do not agree to these terms and conditions, please do not use this site.  By placing an order with www.tqleds.com you acknowledge that you’ve read and accept our terms and conditions.  These are subject to edit without prior notification.     

 

1.  Products

Prices may change and products may be discontinued at any time for any reason tqleds.com deem necessary.   All prices are to be paid excluding shipping and handling charges.

 

2.   Order Cut-off Date 

Purchase Order and make 50% upfront payment by the 9th day of the month,  and you will received the goods within 10-12 weeks.  However should you miss the cut-off date and you need the goods to be deliver asap, we will advice you on the express courier charges and proceed with the courier service arrangement upon agreement with you on the charges and the estimated goods arrival date.
 

3.  On-loan Equipment

All on-loan equipments need to be purchased unless it's available at time of request.  It's the responsibility of Project Consultants to make sure the proposed products are avilable for demo or testing requested by their clients. If on-loan equipments are taken out from www.tqleds.com without being paid for, it is the responsibility of the Project Consultant/borrower  to return the loan equipments in perfect and good working condition within seven (7) days from date taken.  Otherwise, we will consider the loaned equipment sold and will submit an invoice to the Project Consultant/borrower for payment demand, unless prior written request for loan period extension is approved by ww.tqleds.com. 

 

4.  Orders Instructions

Orders are accepted and processed as per our abilities and availabilities. You will receive an order confirmation when the order is received from us.  The only instance you will receive additional communication from us is if there is a problem with your order.  Otherwise, consider it accepted.

Ordered goods cannot be cancelled. Goods are sold and considered as accepted in our offices and warehouses, regardless of place, means or conditions of the delivery.

Minimum Order

tqleds.com do have a minimum USD5,000.00 for orders placed and shipped out within Malaysia. There is a USD30,000.00 merchandise minimum for orders shipped out of the Malaysia.

There is a USD1000.00 merchandise minimum for orders paid by Bank Transfer (USD50.00 bank fee charges applies).

These minimums do not include shipping costs.

a.       Order Status

Our system is set up to send a tracking number notification via email when the order ships. Please check that the email is not caught in any spam filters that you may be using.

One important point to note is that Insurance does NOT guarantee that the insured goods will:

Ø  Arrive on time, or arrive at all

Ø  Reach the destination port safely

Ø  Receive in order without damage or loss

Insurance is designed to indemnify the insured party against any physical damage or loss that occurs during transportation as the result of the risks specified in the agreed insurance policy. It is aimed at reducing or removing the financial burden that accompanies such potential damage or losses.

6.  Delivery

All orders will be shipped within 10-12 weeks as per our Terms of Purchase stated in our quotation to you upon full payment received and settled.  Orders will be shipped via Pos Laju for Nationwide Malaysia and DHL/FeDEX/EMS Courier for outside of Malaysia.  Upgraded shipping will result in an additional shipping charge.  Orders will be shipped Monday through Friday.  www.tqleds.com cannot be responsible for delay in shipping.  Weather delays and other causes out of our control may affect shipping and delivery time.

 

7.  Mistaken, Wrong/Incorrect and Damaged Products Shipments

a.       Damaged or Wrong/Incorrect Items: *Items damaged during shipment: Please Contact Us if you receive damaged or wrong/incorrect items and tqleds.com will gladly replace the item or provide a full refund for the product damaged and wrong/incorrect products within seven (7) days from the shipping date goods received acknowledgement.  Always bear in mind and take serious note to inspect all the goods once you received, then call or email us if goods are damage or wrong/incorrect items being delivered.   Please take a few camera shots and vido on the broken items or wrong/incorrect products and  email to tqleds@gmail.com

b.       Errors in Shipping:  At tqleds.com we have a shipping accuracy of 99.8%.  We are human and sometimes make mistakes.  If this happens, simply Contact us and will ship the correct order immediately.  We ask that you return the items sent in error and let us know what the shipping cost was to you.  You will then be credited for that amount back on your credit card.

c.        International Shipments:  If we have shipped your order to a freight forwarded, all third parties must inspect merchandise when they receive it.  We will not be responsible for any damage that is done to merchandise once it has been reshipped by any third party.  Tqleds.com is only responsible for shipping via our shippers.

 

8.  Using www.tqleds.com

a.       While using  tqleds.com sites, services and tools, you may not:

(i)     post content or items in an inappropriate category or areas on our sites and services;

(ii)    violate any laws, third party rights or our policies;

(iii)   use our sites, services, or tools if you are not able to form legally binding contracts, are under the age of 18, or are temporarily or indefinitely suspended from using our sites, services, or tools;

(iv)  fail to deliver payment for items purchased by you, unless the seller has materially changed the item's description after you purchase, a clear typographical error is made, or you cannot authenticate the seller's identity;

(v)   manipulate the price of any item or interfere with other users' listings;

(vi)  circumvent or manipulate our fee structure, the billing process, or fees owed to tqleds.com;

(vii) post false, inaccurate, misleading, defamatory, or libelous content (including personal information);

(viii)take any action that may undermine the Feedback or ratings systems (such as displaying, importing or exporting Feedback information off of the sites or using it for purposes unrelated to tqleds.com);

(ix)  distribute or post spam, unsolicited, or bulk electronic communications, chain letters, or pyramid schemes;

(x)   distribute viruses or any other technologies that may harm tqleds.com, or the interests or property of tqleds.com users;

(xi)  export or re-export any Tqleds.com tools except in compliance with the export control laws of any relevant jurisdictions;

(xii) copy, modify, or distribute rights or content from the tqleds.com sites, service, or tools or tqleds.com's copyrights and trademarks; or

(xiii) harvest or otherwise collect information about users, including email addresses, without their consent.

 

9.  Abusing tqleds.com

a.     Please report problems, offensive content, and policy violations to us.

1. Tqleds.com works to ensure that listed items do not infringe upon the copyright, trademark, or other intellectual property rights of third parties. If you believe that your intellectual property rights have been violated, please notify our Customer Support team through our www.tqleds.com/support and we will investigate.
2. Without limiting other remedies, tqleds.com may limit, suspend, or terminate our service and user accounts, prohibit access to our sites and their content, services, and tools, delay or remove hosted content, and take technical and legal steps to keep users off the sites if tqleds.com think that they are creating problems or possible legal liabilities, infringing the intellectual property rights of third parties, or acting inconsistently with the letter or spirit of our policies. Tqleds.com also reserves the right to cancel unconfirmed accounts or accounts that have been inactive for a long time, or to modify or discontinue tqleds.com sites, services, or tools.

 

10.  Buyer Purchasing Policy

a.     By submitting your order for processing by tqleds.com, you confirm and affirm that you have read, understood and agree to the Terms and Conditions in the form in which they appear at the time your order is submitted for processing.

1. The Customer shall agree to complete the registration process according to tqleds.com’s  requirements as stated on this site. The Customer shall provide tqleds.com with complete and updated information which shall include (but shall not be limited to) the Customer's legal name, address, telephone and fax numbers (optional) and e-mail address.
2. The Customer may place his order via our website at www.tqleds.com. The Customer will receive a confirmation of receipt of order via e-mail. For clarification, such confirmation of receipt of orders does not guarantee stock availability.
3. Access to tqleds.com is gained through use of a personal email address and password number. The Customer shall ensure that his/her personal email address and password number is kept strictly confidential to prevent unauthorized use. Tqleds.com shall use its best endeavors to prevent any unauthorized entry to the tqleds.com internet site. However, tqleds.com not be liable for any damages or losses whatsoever if any third party gains unauthorized access to the Tqleds.com internet site.
4. Tqleds.com is not responsible for the installation or removal costs of any parts sold. Customer is responsible for the installation or removal of parts for warranty service.

 

11.  Pricing Policy

Tqleds.com shall make every effort to ensure that the prices, details and sizes of Products detailed by the tqleds.com are correct; however tqleds.com reserves the right to vary the prices and other details of the Products without prior notice.

a.     Not all Product sizes will correspond exactly to the description offered on-line. Tqleds.com reserve the right to provide the nearest size of Product at the nearest price.

1. Discrepancies between the on-line bill/order price and the final bill may be due to out-of-stock products, substitutions, special offers, daily price changes and weighed items. Tqleds.com reserves the right to adjust the final bill after the on-line bill/order price is presented or conveyed to the Customer and such adjustments shall be marked on the final bill presented to the Customer at the time of delivery.
2. If the Customer requests a variation to the order which tqleds.com accepts then the price payable for the order will be adjusted accordingly to reflect the variation and shall be recorded on the final bill presented to the Customer at the time of delivery.

 

12.  Quotation and Currecy Exchange Fluctuation Policy

(a)  Currency Exchange Rate:  The prices quoted offered are based on actual rate on the quoted exchange rate of USD currency rate.  Any quotation will be subjected to adjustment if exchange rate fluctuates beyond 3% based on quotation date.  We reserve the right to request the Buyer to bear the possible loss caused by fluctuation of the exchange rate.

 (b)  Quotation Validity Period: Above quotation is for one (1) from the quoted date depending on the request for price validity period.

 (c)  Quoted Price Validity Price Extension:  Extension of price validity period can be done by submitting a fomal request to www.tqleds.com for approval, prior expiry of the validity period to avoid any inconvenience or disagreement.

 

13.    Pricing and Billing  

All prices are in U.S. Dollars and/or Ringgit Malaysia and are subject to change without advance notice.


(a)  Banker Check or TT Transfer
Our web site does not allow payment by bankers check or TT Transfer. If you prefer to pay by personal check, cashier’s check or TT Transfer (with USD50.00 Bank Fee applies per transaction made), please call us to place your order.

tqleds.com only accept checks drawn on Malaysia banks. Checks and TT Transfer (with US$40.00 - USD50.00 Bank Fee Charges applies),  must be for the exact amount of the purchase plus USD50.00 Bank Fee applies for TT Transfer.  Personal checks/cheques delay shipment until the check/cheque clears - up to 10 business days from the receipt of payment. 

tqleds.com  reserve the right, without prior notification, to limit the order quantity on any item and/or refuse service to any customer.

c.  International Shipping
International customers outside of Malaysia are responsible for all customs and import duties collectible at the point of goods receivable. Tqleds.com will not collect these fees in advance nor can tqleds.com predetermine the amount. Tqleds.com recommends that you contact your local customs agency before placing your order so that you are aware of the duties and taxes that your country may charge.

 

14.  Variation / Cancellation Policy

No order can be cancelled, unless this is done up to the point in time that tqleds.com has not commenced processing and only with our explicit prior consent. In this case, the customer will owe us a fee valued at 50% of the respective total order amount.

1. Subject to the Customer's consent, tqleds.com may substitute a Product for another similar Product if the initial Product ordered by the Customer is unavailable.
2. If there is no prior consent from the customer for a substitution, no substitution shall be made.

 

15.   Customer Satisfaction Policy

a.       The Customer is guaranteed at all time that all products are 100% Original and Genuine.

1. Product(s) delivered by "tqleds.com" must as per described in "tqleds.com" web ads material. Customers have the right to reject and return the purchased product(s) to "tqleds.com" and all cost shall be borne by "tqleds.com".

 

16.  Property Risk

All risk in the Products shall pass to the Customer upon delivery to the Customer's delivery address but tqleds.com shall retain title in the Products until such time as payment for the Products has been effected.

 

17.  Returns/Refunds Policy

Please choose carefully as tqleds.com will not accept returns simply because you ordered the wrong thing or have changed your mind. 

Very few customers return products to us, however, tqleds.com want you to be satisfied with your purchase from tqleds.com. Tqleds.com will consider on case by case basis to gladly refund your purchase, less shipping charges*. The agreed returns procedure is as follows:

                    I.            Contact Us for return instructions, kindly email to tqleds@gmail.com indicating the reason for the return.

                  II.            All items must be returned, new and undamaged*, within 7 days of purchase in the original shipping container. tqleds.com are not able to reimburse you for return shipping charges*.

               III.            Parts must be in new, re-saleable condition, and in their original packing, otherwise will not be accepted or credited.

                IV.            tqleds.com will process a refund of your purchase, less 60% restocking fee and shipping charges*, within two calendar months from the date the item is returned shall be stated in your credit card statement.  You can either choose to receive a refund or credit towards a replacement order.  There is a 60% restocking fee if products are received without notifying us prior to sending.

                  V.            All returns must be accompanied by original invoice / shipping details.

                VI.            Customer is responsible for all return shipping charges on exchanges, defective items, wrong item.  tqleds.com will not refund return shipping.

             VII.            tqleds.com reserve the right to reject returns on non-defective or defective products.  Returns will be handled on a case by case basis.

 

a.     Product pictures provided on this site are for the purpose of recognition. Due to packaging, redesign and improvements made, the product may not reflect exactly as the pack you receive. Tqleds.com take all reasonable care to ensure that all descriptions, details and prices of products appearing on the website are correct at the time when the information input onto the system, the information appearing on the website at any time may not reflect the exact information at the moment you place an order.

1. Tqleds.com shall use its best efforts to ensure that orders are correctly fulfilled. Should there be any discrepancy, please notify us within 7 working days either by placing a report to tqleds@gmail.com by the next working day. Returns/Refunds can be arranged under the following circumstances:

(i)      If any Product have been delivered in a damaged condition, or if a Product which was ordered and invoiced is not included in the delivery, or if the wrong Product is delivered, tqleds.com shall either refund the Customer the value of that Product, or replace the Product.

(ii)     if any Product which was not included in the Customer's order is delivered to the Customer, tqleds.com shall collect the Product from the Customer.

(iii)   If the Customer has been charged for a Product which has not been delivered, tqleds.com shall refund the Customer the value of the Product as originally charged to the Customer.

(iv)  If a Customer is charged more than the value of a Product, tqleds.com shall refund to the Customer the difference.

1. All refunds will be made via the same mode of payment on which the original purchase was made within one month.

d.    Refused / Rejected Shipments

If customers reject the package because of customs issue or other issues arouse at their side, tqleds.com will not be responsible for arranging any refund towards the rejected package as tqleds.com have fulfilled our obligation to complete and ship the orders to customers. 

 

Any customer who refused delivery of an order will be required to pay return freight and shipping charges. These charges will be debited into your credit card without your prior consent for refused or rejected delivery of this ordered. 

If a package is returned to us because of wrong address given, tqleds.com will reship the package to you and additional shipping fee is applied and will be charged accordingly.

 

18.  Resolution of Disputes

If a dispute arises between you and tqleds.com, our goal is to provide you with a neutral and the most cost effective means of resolving the dispute quickly. Accordingly, you and tqleds.com agree that tqleds.com will resolve any claim or controversy at law or equity that arises out of this Agreement or our services (a "Claim") in accordance with one of the subsections below or as tqleds.com and you otherwise agree in writing. Before resorting to these alternatives, tqleds.com strongly encourage you to first contact us directly to seek a resolution by going to the Customer Support help page

 

19.   Privacy

Tqleds.com do not sell or rent your personal information to third parties for their marketing purposes without your explicit consent. Tqleds.com view protection of users' privacy as a very important community principle. Tqleds.com store and process your information on computers located in the Malaysia that are protected by physical as well as technological security devices. You can access and modify the information you provide us and choose not to receive certain communications by signing in to your account.

 

20.  No Agency

No agency, partnership, joint venture, employee-employer, or franchiser-franchisee relationship is intended or created by this Agreement.

 

21.  Limited Warranty

Unless otherwise noted, all products are warranted to be free of defects in materials and workmanship for one year from the date of purchased, selective products have extended warranty periods. Warranty is void when products are used in applications that they are not intended for.  A copy of the invoice is required for warranty repairs or replacements. Please call or email to notify us prior to returning items for warranty repair or exchange. You are responsible for return and all relevant shipping charges.

(a)      Replacement Criteria

In the event that any tqleds.com product is found to be defective in materials or workmanship within warranty period, tqleds.com will replace the product upon meeting the following criteria:

• Customer contacts original distributor / place of purchase to verify original purchase and date
• Obtains an RMA (Return Merchandise Authorization) number from original distributor / place of purchase
• Customer returns defective product to the Tqleds.com facility designated on the RMA for inspection
• tqleds.com will inspect all returned product for misuse and or damage prior to replacement of product.

(b)       Disclaimers

Tqleds.com will not replace or issue credit for any product that has been misused, mishandled or improperly installed, as determined by our inspection upon returned. Tqleds.com is not responsible for replacement or credit of any tqleds.com products once the specified warranty period expires. In the event that a product is misused or damaged by the customer prior to the expiration of the warranty period, tqleds.com disclaims all obligations under this Warranty. Warranty is not transferable unless approved, in writing, by tqleds.com prior to any warranty claim. Any physical damage, changes to the product, or defacing of labels on parts & components voids warranty. EXCEPT FOR THE FOREGOING, TQLEDS.COM DISCLAIMS ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR USE OR FITNESS FOR A PARTICULAR PURPOSE. In no event shall tqleds.com be liable for any other costs or damages, including lost profits, incidental, special or consequential damages.

(c)      No agent or representative of  tqleds.com is authorized to make any warranties, representations or statements regarding the Products and tqleds.com not in any way be bound by any such unauthorized warranties, representations or statements.

Warranty is void if the product is
Damaged due to negligence, abuse, accident, modification, tempering, alteration, faulty installation, not adhered to International Industry Guideline to Product IP Protection Grade Guidelines and/or acts of God.  Modified or repaired by anyone than tqleds.com.  The extend of tqleds.com, under this limited warranty is the repair or replacement of the product at the sole discreation of tqleds.com .  Under no circumstances shall incidental, forseen, unforeseen, special or consequentialdamage arising out of or in connection with the use of this product.  The shipping cost has to be borne by the customers for all the replacement or repair cost involved include any Government custom and Duty charges applied.  

 

22.  Liability

a.     The liability of tqleds.com whether in contract, tort or otherwise for any loss, damage or injury arising directly or indirectly from any defect in or non-compliance of the Products or any other breach of tqleds.com 's obligations hereunder shall not in any event exceed an amount equivalent to the price of the Products.

1. tqleds.com shall not be liable for any consequential, indirect or special damage or loss of any kind whatsoever nor shall tqleds.com be liable for any damage or loss caused by the Customer's servants, agents, buyers or other persons whatsoever.
2. The Customer shall ensure that the Products are not used for any purpose for which they are not suitable and shall be responsible for using all necessary skill and care in handling and using the Products. The Customer expressly acknowledges and agrees that tqleds.com assumes no obligation or liability for any advice or information given with the Products and tqleds.com shall not be responsible for any inaccuracy or misstatement of any such information. The Products shall be accepted by the Customer entirely at the Customer's risk.

 

23.  Variation of Terms and Conditions

tqleds.com reserve the right to amend these Terms and Conditions at its sole discretion. tqleds.com may or may not reserve the right undertake in notifying the Customer of such changes. It is the Customer's responsibility to review the Terms and Conditions prior to submitting any order and tqleds.com shall have no responsibility to notify the Customer of any changes to the Terms and Conditions prior to the coming into effect of such changes or otherwise.

 

24.  Applicable Law

These Terms and Conditions shall be governed by the laws of Malaysia and the Customer and tqleds.com agree to submit to the jurisdiction of the Malaysia courts.

 

25.  Links

The tqleds.com internet site may contain links to other sites and pages. By activating a link, such as for example by clicking on the banner of an advertiser, the Customer leaves tqleds.com site and tqleds.com does not exercise control over any personal data or any other information the Customer gives to any other entity after leaving the site and access to such site or page is at the Customers own risk for which tqleds.com disclaims all responsibility and liability.

 

26.  Content

All reasonable efforts are made to ensure that the information provided on this site is correct and up-to-date. However, tqleds.com disclaims all implied and/or express warranties and makes no representation as to the accuracy or completeness of any information on the site. Tqleds.com takes no responsibility and assumes no liability for the content of the site or for anything posted on or linked to it, including without limitation any mistake, error, omission, infringement, defamation, falsehood, or other material or omission that might offend or otherwise give rise to any claim or complaint. (See also without limitation the words in capitals below)

 

27.  Limitation of Liability

By accessing and using this Tqleds.com internet site, the Customer acknowledges and accepts that the use of the site is at the Customers own risk. Tqleds.com shall not be liable for any direct, indirect, incidental, consequential or punitive damage or for damages for lost profits or for loss of revenue arising out of any use of, access to, or inability to use the site. Without limiting the foregoing:

THIS SITE AND ALL INFORMATION AND MATERIALS CONTAINED IN IT ARE PROVIDED "AS IS" WITHOUT ANY WARRANTY OF ANY KIND EITHER EXPRESS OR IMPLIED INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OR IMPLIED TERMS AS TO TITLE, QUALITY, MERCHANTABILITY, FITNESS FOR PURPOSE , PRIVACY OR NON-INFRINGEMENT. TQLEDS.COM HAS NO LIABILITY OR RESPONSIBILITY FOR ANY ERRORS OR OMISSIONS IN THE CONTENTS OF THE SITE.
